Workers' Compensation

The manager must report all employee work-related injuries, illnesses, and near-miss incidents arising out of and in the course of employment to Human Resources Management within one business day of notice or knowledge of the incident.

When an injury, illness, or near-miss incident occurs, the Employee Report of Injury/Illness form must be provided to the employee. When an injury or illness requires medical treatment beyond first aid, the Workers' Compensation Claim Form (DWC-1) must also be provided to the employee within one business day of notice or knowledge of the need for medical treatment. The manager is responsible for completing the  Supervisor's Report of Injury and Illness form and submitting to Human Resources Management within one business day.

Human Resources Management is required to report a workers' compensation injury or illness to our third-party administrator within five calendar days of knowledge or notice by the employee. Delays in completing these forms can result in delays in treatment and potential workers' compensation benefits to the injured or ill employee.

Please encourage all employees, including student assistants and volunteers, to report any work-related accidents and/or near-miss incidents when they occur. Timely reporting assists in identifying campus safety issues and determining eligibility for benefits. 

Note: First aid injuries where treatment is sought in the form of first aid kits in the department do not need to be reported to Human Resources Management.

Who is covered?

Authorization for Medical Treatment

An employee who sustains a work-related injury or illness may receive, at no cost to them, medical care that is required to cure or relieve the effects of the injury or illness. An employee who needs medical attention may not be transported by another University employee(s).

Important OSHA Requirements

Managers MUST report all serious injuries, illnesses, and work-related deaths immediately (within 8 hours) to Human Resources Management and Environmental Health and Safety (EHS). Reporting delays could result in delayed medical treatment and Cal/OSHA fines.

A serious injury or illness requires inpatient hospitalization for a period in excess of 24 hours for other than medical observation or in which an employee suffers a loss of any member of the body or any serious degree of permanent disfigurement.

Notice of Return-to-Work

Employees who have lost time away from work due to an industrial injury or illness must submit a medical certification of their work status releasing them to return to work with or without work limitations. This notice must be sent to Human Resources Management prior to the employee’s return to work.

All lost time must be verified in writing from a medical provider’s report of injury, also known as a work status report.

When an employee is released to return to work with work limitation(s), the manager must contact Human Resources Management to collaborate with the department to determine whether a temporary transitional duty work assignment is available.
