Campus Clery Geography

Location, Location, Location.

The Clery Act requires institutions to disclose statistics for reported Clery Act crimes that occur (1) on campus, (2) public property within or immediately adjacent to the campus, and (3) in or on non-campus buildings or property the institution owns or controls (i.e. rents, leases, or has a written agreement for use of the property).

On-Campus

Any building or property owned or controlled by an institution within the same reasonably contiguous geographic area and used by the institution in direct support of, or in a manner related to, the institution’s educational purposes, including residence halls; and Any building or property that is within or reasonably contiguous to the area identified in paragraph (1) of this definition, that is owned by the institution but controlled by another person, is frequently used by students, and supports institutional purposes (such as a food or other retail vendor). State ownership constitutes control for state institutions.

Controlled by means that your institution (or an institution-associated entity as described below) directly or indirectly rents, leases or has some other type of written agreement (including an informal one, such as a letter or an e-mail) for use of a building or property, or a portion of a building or property. Even if there is no payment involved in the transaction, for Clery Act purposes, a written agreement for the use of space gives your institution control of that space for the time period specified in the agreement.

On-Campus Student Housing Facility

Any student housing facility that is owned or controlled by the institution, or is located on property that is owned or controlled by the institution, and is within the reasonably contiguous geographic area that makes up the campus is considered an on-campus student housing facility (Official Greek chapter houses OWNED by the University within a mile of campus fall here).

Reasonably contiguous refers to a building or property your institution owns or controls that’s in a location that you and your students consider to be, and treat as, part of your campus.

Public PropertyAll public property, including thoroughfares, streets, sidewalks, and parking facilities, that is within the campus, or immediately adjacent to and accessible from the campus. For CSUDH, this is the public sidewalk that borders the campus, the public street and the public sidewalk on the other side of the street.
Non-CampusAny building or property owned or controlled by a student organization that is officially recognized by the institution; or any building or property owned or controlled by an institution that is used in direct support of, or in relation to, the institution’s educational purposes, is frequently used by students, and is not within the same reasonably contiguous geographic area of the institution. (Official Greek chapter houses that are OWNED BY THE CHAPTER or other official Student Organization owned residential properties fall here). Non-campus geography can mean student trips if it meets the criteria for Classifying Student Trips.
